There is no question that the respective legal systems in Alberta and within Canada are incredibly complicated. It takes even people who have gone to law school a number of years to get up to speed as lawyers in their practice areas. It is also true that lawyers are expensive. Access to Justice is a real issue facing the Courts, and society as whole.
The expense of lawyers and the complexity of the system unfortunately leaves some people with no choice but to act for themselves. The courts often bend over backwards to assist these people, but the processes of the trial and similar processes can be overwhelming for laypeople.
While much work needs to be done to resolve this issue, lawyers can offer unbundled legal services, called limited scope retainers. For example, you might hire a law firm to draft just the statement of claim in a lawsuit, or draft an application, or negotiate with the other side. There are a number of steps that lawyers can break out of the litigation process using this approach. While this approach is not perfect, it can be helpful in certain instances.
